General terms and conditions of the Anoa Online Shops
§ 1 - provider, inclusion of the general terms and conditions
(1) Provider and contractual partner for the goods shown in the Anoa online shops are the managing directors Stefanie Wick & Doreen Haverkamp, Bernhard-Schumacher Weg 22, 48268 Greven, email hello@anoa-shop.com (Briefly "provider" below).
(2) These general terms and conditions are part of each contractual agreement between the provider and the respective buyer. Conflicting terms and conditions of the customer is contradicted.
§ 2 - range of goods and the conclusion of the contract
(1) The buyer offers customers for sale in his Anoa online store. The color representation of the items on the website can vary slightly depending on the internet browser and monitor settings of the customer used; These deviations are never completely avoidable.
(2) The selection of goods, contract and contract processing are carried out in German.
(3) The provider delivers worldwide.
(4) The buyer selects the desired goods by placing them in the "shopping cart" or clicking on the shopping cart button. The order request can finally be transmitted to the provider using the "Order payment of payment" button. The customer has the option of viewing and changing the data provided during the order at any time until the order request is sent or canceling the order.
(5) For the goods shown in the Anoa Online Shop, the provider gives a binding purchase offer. By sending the order request via the "Order" button, the customer accepts the purchase offer. The provider confirms the conclusion of the contract by email (contract confirmation).
(6) The content of the contracts concluded is saved in the AnoA user account of the customer and is always visible for the customer in the Anoa Online Store via the "Logging in" menu under the point "My purchases".
(7) In the event of delivery obstacles or other circumstances that would counter the fulfillment of the contract, the provider informs the buyer by email.
§ 3 - prices and payment
(1) All product prices are understood as final prices plus shipping costs. The fees contain 19% sales tax.
(2) The shipping costs are listed under the menu item "Shipping".
(3) In the case of deliveries to Switzerland, customs and import sales tax may be incurred, which the buyer must be paid to the customs authority when receiving the shipment. In addition to the purchase price and shipping costs, these taxes are incurred and cannot be influenced by the provider.
(4) At the time of the buyer, the provider delivers against prepayment by redeeming a voucher, against prepayment by bank transfer, against prepayment by means of PayPal-Payment, against advance payment using PayPal Plus payment or against prepayment using a credit card. With the contract confirmation, the buyer receives an internet link by email that leads him to the "My Purpose" area, which contains further information on the purchase.
a) The buyer can enter a voucher code for payment using a voucher. The voucher value is credited to the provider and the invoice amount is paid in this way. If a voucher value is higher than the invoice amount, the voucher remains valid in the amount of the exceeding amount. In principle, only one voucher is accepted per order. Several vouchers or different vouchers cannot be redeemed when ordering. A cash payment from Anoa Online Shop vouchers is also excluded.
b) If the buyer has chosen "bank transfer" as a payment method, the customer will be informed of the provider's bank details in the order confirmation by email. Transfers from abroad only accept the provider as expenses -free payments in euros. The transmission of money in the event of a transfer, whether online or by transfer provider, must be completed within 10 days and can be between 1-3 days depending on the bank. If the payment does not arrive within 10 days, the order will be automatically canceled.
c) If the buyer has chosen "PayPal" as a payment method, he comes to the PayPal online service via the button "Click here to pay with PayPal" and can arrange the payment there.
d) The buyer can use a Visa or MasterCard credit card for advance payment. The provider has commissioned Shopify and authorized it for their payment processing. The "Click here to pay with a credit card" leads the customer to a page set up by Shopify, where he can arrange for the payment.
§ 4 - Shipping, delivery times
(1) The provider delivers the goods within the period mentioned in the menu item "Shipping".
(2) For products that are marked as "individualizable" in the product description, the delivery time increases by a week if the customer instructs such individualization.
(3) For programs on targets outside of Germany, the delivery time increases by another 2-9 working days, depending on the target country.
(4) Several products ordered simultaneously are delivered in a common shipment; The delivery time of the product with the longest delivery time applies to the common shipment. If the customer wishes to deliver a specific product with a shorter delivery time in advance, he must order this product separately. As an exception to an advent calendar order: so that the advent calendar can be ordered earlier, but does not have to be waited for the other ordered products, the other ordered products are sent within the regular delivery time.
(5) If the delivery fails to the buyer because the buyer has specified the delivery address incorrectly or incompletely, there is only another delivery attempt if the buyer pays the immediate costs of the new shipping. These costs correspond to the shipping costs agreed when the contract is concluded.
(6) If the buyer has chosen cash payment as a payment method, the goods are not sent. Instead, the buyer can collect the goods at the provider's place of business after the expiry of the time mentioned in the product description; For individualized products (see paragraph 2), the time is extended by one week.
§ 5-Consumer Call right
(1) A buyer who buys as a consumer is entitled to a right of withdrawal in accordance with the legal conditions. Consumer is every natural person who concludes a legal transaction for purposes that can mostly be attributed to their commercial nor their independent professional activity.
(2) The provider admits a 14-day cancellation period to a consumer with a constant stay outside of Germany if the national law of the consumer provides for a shorter period of time.
(3) The provider admits to a consumer with a constant stay outside of Germany to provide the declaration of cancellation evenly if the consumer's national law provides for a stricter form.
(4) The prerequisites and legal consequences of the German Consumer Call rights also apply to consumers with a constant stay in Switzerland, even if a revocation is not provided for in Swiss law.
(5) General note: Goods damaged by the buyer is excluded from the revocation. This also applies in particular to the advent calendar that is open and/or damaged.
§ 6 - Warranty
The buyer's warranty rights are based on the legal regulations.
§ 7 - Data protection information
(1) After the contract is concluded, Anoa transmits the AnoA user name, the name and the invoice address, as they are stored in the buyer's user account. If the buyer has given further data as part of his order (e.g. a different delivery address or a telephone number), this will also be transmitted.
(2) The provider processes the data mentioned in paragraph 1 electronically for proper contract fulfillment, in particular for shipping, invoicing and posting payments. For the purpose of shipping, the provider can also send the name and address of the customer to the contracted shipping company.
(3) The provider keeps the data stored until all mutual claims from the order are fully completed and the commercial and tax law retention obligations for the provider expired.
(4) The buyer can request information from the provider at any time about the data he has saved through the buyer. Furthermore, the buyer can request the correction of incorrect data at any time.
a) The responsible body for data protection is the provider mentioned in § 1 paragraph 1.
b) If the buyer uses PayPal's service for payment, the PayPal data protection regulations also apply to the payment process. PayPal is acted as an vicarious agent of the customer, not the provider
c) If the customer uses a payment method offered via Wirecard, collect and process Wirecard the name of the customer, its card or account number and/or other data required for the selected payment method. In this respect, the Wirecard data protection regulations apply.
(5) Definitely when accepting or paying
If the buyer does not accept the goods at the agreed location or does not collect them in a reasonable time in the kept DHL package shop, the AnoA online shop is entitled to withdraw from the contract after setting and unsuccessful expiry of 14 days. In this case, the Anoa Online Shop is entitled to assert 12 percent of the gross price as a general compensation instead of the service, because the buyer shows that only a much lower or no damage has occurred. Anoa online shop reserves the right to assert a higher damage.
(6) Reference to retention of title
The goods delivered remains the property of the Anoa Online Shop until full payment.
(7) Liability of the statutory liability
The provider is liable for defects in the goods according to the legal provisions, in particular §§ 434 ff. BGB and the mandatory rules of the purchase of consumption. The customer is only entitled to a guarantee if Anoa online shop has given it separately. As far as possible, the buyer uses the original packaging. Anoa Online Shop expressly points out that the assertion of claims for defects and/or claims for damages as well as the exercise of the right of withdrawal does not depend on this.
§ 8 - Data protection
Anoa Online Store will observe all data protection requirements, in particular the requirements of the Telemedia Act. More information on this is below the point Data protection to be viewed.
§ 9 - final provisions
(1) The law of the Federal Republic of Germany applies to the exclusion of the UN sales law. However, German law does not apply to consumers with a constant stay abroad, provided that the national law of the consumer contains regulations, from which at the expense of the consumer cannot be deviated from the contract.
(2) If individual provisions of these general terms and conditions prove to be ineffective or unenforceable, this does not affect the effectiveness of the other provisions.
